Apple recently released IOS 18, the latest version of the firm’s operating system, which includes Apple’s proprietary AI tool called “Apple Intelligence.
If your firm is SEC or FINRA registered or if you have legally protected data (PII, NPI, PHI, etc.) accessible from your employee’s phone (at a minimum think e-mail), this could be a major headache for Chief Compliance Officers.
If your firm allows the use of Bring Your Own Devices (BYOD), such as mobile phones and tablets, the emergence of an AI tool that is embedded within the operating system poses legal and regulatory challenges related to the protection and possible leakage of that data via the use of AI tools with access to your firm’s data.
While this is very recent issue, we are already seeing firms looking to determine if they need to restrict the new Apple AI capability on company issued phones. This issue is a lot more challenging, however, for companies that allow their employees to use personal devices.
